These General Conditions of Sale govern the commercial relations between Vromton (brand of the company Rock'N'Truck SAS) and any person making a purchase on the site (hereinafter referred to as the "Customer"). They apply for the entire duration of their posting online by Vromton . The Customer acknowledges having read, before payment, the General Conditions of Sale set out on the website www.vromton. com.

Acceptance of the General Conditions of Sale by the Customer is materialized when validating the basket by clicking, for each order, on the button: “Proceed to payment”. If the Customer clicks directly on one of the ShopPay, PayPal buttons or a button of another direct payment application present on the site, a pop-up appears indicating that the Customer accepts the T&Cs and the conditions of use. These general conditions of sale will prevail over all other conditions appearing in any other document, except with prior, express and written agreement from Vromton. Vromton reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Customer service

The Products sold by Vromton are manufactured with care and packaged with care. The essential characteristics of the products are indicated in their respective description, the only contractual source. Pre-order

The Customer has the possibility of pre-ordering a Product before its marketing if this is actually mentioned on the site. He places his pre-order like any other order but will only be delivered from the month mentioned in the Product description.

Order

In order to place an order on the website www.vromton. com, it is possible to create an account either before ordering or during the order, by clicking on “Create an account”. Certain information is mandatory and is therefore necessary for processing the Customer's order who undertakes to provide truthful information. Consequently, in the event of an error in the wording of the Customer's contact details, www.vromton. com is not responsible for the impossibility of delivery of the order. The Customer may, at any time, modify the information provided. The information provided by the Customer when placing the order is binding on the Customer. The Customer can view all of his invoices in my account. Placing and validating an order In order to create their basket, the Customer chooses the desired quantities of the product, then validates by clicking on the “Add to basket” button. Delivery

Delivery is made either by direct delivery to the Customer, or by notice of availability at a postal center in the event of absence.

Late delivery

In the event of a delivery delay, we advise the Customer to check the status of their order directly online before contacting us, on the carrier's website using the shipping number if available. We invite the Customer to notify us of any delay of at least one week compared to the average delivery time observed in order to enable us to start an investigation with the carrier (investigation times can vary from one to three weeks). If, during the investigation period, the Product is found, it will be redirected immediately to the address provided by the Customer when ordering. On the other hand, if the Product is not found at the end of the investigation period, the carrier considers the package as lost and Vromton will return a replacement Product, at its expense. If the indicated deadline is exceeded by more than 7 days, except in cases of force majeure (carrier strike, accident - non-exhaustive list -), the Customer has the possibility of canceling his order and being reimbursed; the Customer must then send Vromton a registered letter with acknowledgment of receipt within 60 working days from the scheduled delivery date. By express agreement, in the event of force majeure (as recognized by French case law), Vromton is released from all liability upon delivery. In all cases, on-time delivery can only occur if the Customer is up to date with its obligations towards Vromton, whatever the cause. In the event of visible damage to the package, the customer has the option of refusing delivery. In the event of damage during transport, a reasoned protest must be made to the carrier and Vromton within 5 days of delivery. In the event of a dispute, the investigation can last up to 21 working days. All complaints relating to a defect in the goods delivered, an inaccuracy in the quantities or their incorrect reference must be transmitted to Vromton within 72 hours of receipt of the package, failing which, the right to complaint will cease to exist. be acquired.

Return and refund

If a delivered Product is damaged or does not give complete satisfaction to the Customer, the latter may return it. The Customer will have fourteen (14) days to do so from the date of receipt of the order.

The customer must send an email to contact@vromton.com to indicate their desire for a return and the procedure to follow will be communicated to them.

The product must be returned in its original condition and packaging, new, unused.

Return costs are the responsibility of the Customer.

If the package is lost or damaged when returning the product, the cost of the damage is the responsibility of the Customer. Products which are not returned within the deadlines and conditions referred to above will not be refunded or exchanged.

Legal guarantees

Vromton is liable for defects in conformity of the goods with the Contract and for hidden defects under the conditions provided for in articles 1641 to 1649 of the Civil Code and articles L211-4 et seq. of the Consumer Code.

Vromton guarantees

If the Product is considered defective by Vromton, Vromton undertakes to offer a promotional code (valid for 1 year) greater than or equal to the value of the defective product. Any delivery costs are the responsibility of the customer. The promotional code issued by Vromton as part of the Guarantee can be combined with current offers but cannot be combined with other current promotional codes. Please contact Customer Service.

Warranty limitation

Vromton's warranty is limited to the replacement of the product recognized as defective and which has been used in conditions consistent with the product description. The Customer is required to present photos of the Product so that Vromton can conclude that the Product is defective.

Price

The prices indicated on Vromton. com are in euros, all taxes included and including VAT. The price indicated on the product sheet excludes delivery costs, which are displayed in the basket summary before paying. Vromton reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the day of the order will be the only one applicable to the buyer. Prices shown include order processing fees. If you request delivery outside French territory, your order may be subject to possible taxes and customs duties when it arrives at its destination. Payment of these duties and taxes is your responsibility and we invite you to inquire with the competent authorities in your country.

Payment

The price invoiced to the Customer is the price indicated on the order confirmation sent by Vromton by email. The price of the Products is payable in cash on the day of the order. Payment is made by credit card bearing the symbol CB (Visa, Master card) via Paypal or Stripe. The order validated by the Customer will only be considered effective when the bank payment centers concerned have given their agreement. In the event of refusal by said centers, the order will be automatically canceled and the Customer notified by email. Payment by credit card is secured via 3D secure. The security of card data transport is ensured by SSL (Secure Socket Layer) encryption and the payment page is hosted on a bank server which ensures the integrity and confidentiality of the data collected. As with payment by credit card, Paypal guarantees the security of your banking data, and saves you from having to enter your card number each time.

Responsibilities

Vromton cannot be held responsible for any damage or harm that may arise from the purchase, use of the kit and its by-products and/or the consumption of any food products manufactured using the kits and Vromton derivative products, whether by customers or third parties. This remains their sole responsibility. Indeed, the vromton kit and ferments make it possible to carry out culinary experiments at home, in therefore non-professional conditions which will necessarily vary depending on the equipment, materials and local conditions of the users, as well as their experience. Customers and users of the vromton kit and its by-products ("kit elements" including vromton ferment sachets) acknowledge by purchasing vromton products that there is a risk in consuming their products, and that Vromton cannot be held responsible for this risk and/or its consequences on the health of users. Only the user is responsible for the health aspect of their creations using the vromton kit. He is solely responsible for the hygiene and safety of his production site and therefore for the possible repercussions in terms of food poisoning if he were to consume or taste products made at home using the vromton kit, or directly involving or indirectly the vromton kit or one of its elements.

Vromton does the maximum in its power to communicate the existing risk of consumption by indicating on its site in the pages of its products concerned an informative mention, as well as in these General Conditions of Sale, in the FAQ, and in the recipe printed in each kit.

As a reminder, and as written in the recipe in each kit, do not consume the preparation if there is any doubt about the development of bad mold, suspicious odor or non-white color. Vromton points out that, like any natural, raw and unpasteurized fermented product, it can happen that “bad” bacteria develop. These do not come from the ferments, controlled in laboratories, but from the natural environment (kitchen or refrigerator for example) or are brought to the vromton during manipulations. This is why we insist on hygiene. Impeccable hygiene is required of users of the vromton kit when tasting products made with the vromton kit (as with any homemade culinary preparation), during the preparation and refining of the vromtons and during their tasting (disinfection of work surfaces , utensils, hand washing...). In cases where Vromton products are offered to third parties or food specialties made by customers or third parties are offered for people to taste, Vromton and the company Rock'n'Truck SAS, as well as their partners and shareholders, cannot be held responsible.

Disputes

These General Conditions are subject to French law. In the event of difficulties in the application of this Contract, the Customer has the possibility, before any legal action, to seek an amicable solution. Please note that the search for an amicable solution does not interrupt the deadlines for legal guarantees (compliance and hidden defects). In the absence of an amicable settlement, any dispute settlement will be within the sole jurisdiction of the Paris Commercial Court.

Discretion policy

The provision of personal information collected for the purposes of distance selling is mandatory, this information being essential, in particular:

  • The Customer's address is useful at the time of the order in order to send him his order on time, the Customer's telephone details allow the delivery people and Vromton Customer Service to contact the customer to follow up on his order,
  • The Customer's email address allows Vromton to confirm the Customer's orders, to send their invoice, as well as to confirm all responses that would be given over the telephone by Customer Service.
